PARK ORDINANCE FREMONT TOWNSHIP, LAKE COUNTY, ILLINOIS
SECTION 1.0 - PARK OPERATION Except for unusual and unforeseen emergencies, the opening and closing hours shall be posted therein for public information. Hours for general park use shall be from daybreak until sunset unless otherwise posted. Any section or part of any park including ponds may be declared closed to the public by the Township Board at any time and for any Intervals (daily or otherwise) and either entirely or merely to certain uses as the Township Board shall find necessary. The finding of lost articles shall be turned in, or reported, to the Township Office. The Township Board or their designee may require the permittee to hire an off-duty police officer or security personnel to patrol the assigned area during any scheduled event of any such permittee and/or sport organizations. The Township Board shall have the authority to revoke a permit upon a finding of violation of any rule governing the use of Fremont Township fields or ordinances, or upon good cause shown.
NO PERSON SHALL: Willfully deface, disfigure, tamper with, displace or remove, any building, bridges, tables, benches, fireplaces, paving or paving materials, water lines or other public utilities or parts of appurtenances thereof, signs, notices or placards, whether temporary or permanent equipment, facilities on park property or appurtenances whatsoever. Fail to cooperate in maintaining restrooms and washrooms in a neat sanitary condition. Dig or remove, whether submerged or not, or any soil, rock, stones, trees, shrubs, or plants, downed timber, or make any excavation by tool, equipment, blasting or other means. Construct or erect any building or structure of whatever kind, whether permanent or temporary, run or string any public utility into, upon, or across Township properties, except when special written permit is issued. Damage, cut, carve, transplant or remove any tree or plant or injure the bark, or pick the flowers or seeds of any trees and plant. SECTION 3.0 - BEHAVIOR Build or attempt to build a fire except in such areas and such regulations as designated by the Township Board. No person shall drop, throw or otherwise scatter lighted matches, burning cigarettes, or cigars, tobacco, paper or other flammable material within any park area or on any highway, road, or street abutting or contiguous thereunto. Enter an area posted, “Closed to the Public” nor shall any person use or abet the use of any area in violation of posted notices. Without authority in writing, gamble or participate in or abet any game of chance. Go out onto the ice of any of the waters. SECTION 4.0 - PHOTOGRAPHY No one is permitted to film or photograph a minor child without the express permission of the parents and/or legal guardians. SECTION 5.0 - DISORDERLY CONDUCT A person shall be deemed to have engaged in disorderly conduct when he knowingly: • Does any act in such unreasonable manner as to provoke, make
or aid in making a breach of peace: SECTION 6.0 - PUBLIC INDECENCY Engage in conduct that is publicly indecent, and a person is deemed to have committed an act of public indecency when, any person performs any of the following acts: • An act of sexual intercourse SECTION 7.0 - OBSCENE BOOKS AND PAMPHLETS Knowingly exhibit, sell, give away, and offer to sell or give away on Township property any obscene book, pamphlet, paper, drawing, movie film, picture, photograph, or any other article of any kind of an obscene nature. SECTION 8.0 - OBSTRUCTIONS Set, place or cause to be set and/or placed any goods, wares or merchandise on any stand, cart or vehicle for the vending of such upon any property of the Township causing an obstruction of use of Township property.
To enter, any Township area, facility or program, that has been rented
or otherwise reserved, without invitation or without having paid the appropriate
admission fee. Nor shall anyone enter any concession without the consent
of the concessionaire, agent or employee. Nor shall any person disturb
any patron of such concession, any participant in any dance, game, picnic,
or a public assemblage. SECTION 9.0 - CONSTRUCTION AND MAINTENANCE Erect, construct, install, or perform any maintenance on, below, over or across Township property except by proper authorization of the Township with any permits as may be needed. SECTION 10.0 - FACILITIES RESTRICTED FOR USE BY SEX Enter into or remain in any toilet, restroom, pavilion or structure or section thereof, which has been reserved and designated for use of the opposite sex (with the exception made for children under five (5) years of age accompanied by an adult). Nor shall any person loiter in or around any restroom or dressing room for soliciting another to engage -in sexual behavior. This section shall not prohibit a person of the opposite sex from assisting a disabled person’s use of the bathroom facilities, and/or in the performance of cleaning and maintenance. SECTION 11.0 - SANITATION To throw, discharge, place or cause to be placed in the waters of any fountain, pond, lake, stream, storm water, or drain flowing into such waters, any substance, matter or thing; liquid or solid, which would or may result in the pollution of said waters. Refuse and Trash: dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste garbage, or other trash. All refuse shall be placed in the proper receptacles. Where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and properly disposed of offsite. SECTION 12.0 - SMOKING Fremont Township is a smoke-free campus.
Possess, give away, sell, serve, dispense or drink any alcoholic beverage,
or possess, sell, deliver, smoke, inhale, inject, eat, chew or swallow
any beer, wine, or other alcoholic beverage, narcotic drug, or controlled
substance, upon any Township property. Any person found to be in violation
of this section shall be subject to arrest or ejected from the Township
premise. To bring in, lead or carry any dog or other domestic animal onto Township property. Nothing in this ordinance is to be construed as to prohibit the use of certain approved animals for purposes of controlled use such as, service dogs, for public safety, the protection of Township property, the protection of employees, or in the performance of duties of search and rescue. SECTION-15.O - VENDING AND ADVERTISING To offer for sale or hire any article or thing, conduct or solicit any business, trade, occupation or professional without the approval of the Township and then only in accordance with terms and conditions prescribed by the Township in control of commercial enterprises or sales on Township lands are not allowed. Display, distribute, post or fix any placard, sign, handbill, pamphlet, circular, or any other writing or printed material or objects containing advertising matter or announcements of any kind whatsoever without permission from the Township. Groups holding a valid picnic/facility rental permit or special use permit may display signs to identify their location or direct others to it, providing such signs are temporary and removed by permittee at the termination of the activity. Solicit contribution in any manner upon the Township facility, except as authorized by the Township Board and associates with the permitee user. SECTION 16.0 - WEAPONS AND HARMFUL SUBSTANCES No one shall at anytime have in their possession or on or about their person any firearm, pistol, revolver, rifle, shotgun, ammunition, bow and arrow, crossbow, slingshot, blackjack, billy-club, or any device capable of discharging a projectile by air, spirit, gas or explosives, or any explosive substance or harmful solid, liquid or gaseous substance any tear gas or disabling chemical agent or other dangerous weapons. Nothing herein is to be construed as to prevent any police officer or security personnel as may be authorized and necessary in the discharge of their duties. Nor shall it apply to any person summoned by any such officer to assist in making arrests or preserving the peace while such person is engaged in assisting. Bring into Township property any-trapping devise, any incendiary bomb or material, any smoke or stink bomb, any acid or caustic substance or any inflammable Iiquid, except charcoal lighter or fuel contained in the fuel tank of a motor vehicle. Discharge any weapons or instruments into or over Township property. SECTION 17.0 - PYROTECHNICS Possess, set off, attempt to set off or ignite any firecrackers, fireworks, smoke bombs, rockets, black powder, guns or other pyrotechnics without written approval, and then only under such rules and regulations as may be promulgated by the Township and subject to all local, state, and federal laws. SECTION 18.0 - TRAFFIC Fail to comply with all applicable provisions of Illinois State and Lake County Motor Vehicle Traffic Rules and Regulations Laws with regard to equipment and operation of vehicles together with such regulations Fail to obey all traffic officers’ security personnel and park employees authorized and instructed to direct traffic. Fall to observe all traffic signs indicating speed, direction, caution, stopping, parking, cross walk lanes, traffic lane markers, and all other signs posted by the Township, for proper control for safeguarding life and property. Drive any vehicle on any area except the paved park roads or parking areas. Alternatively, on such other areas as might on occasion be specifically, designated as temporary parking areas. Park a vehicle on a driveway in such a manner or under such conditions as to leave available less than 20 feet of the width of the driveway for free movement of vehicular traffic, except any one way driveway -such limitations shall be 10 feet. Double-park any vehicle on any driveway unless directed by a park official or temporarily for discharging passengers. Do not leave a vehicle standing or parked at night without lights clearly visible for at least 200 feet from both front and rear on any driveway or road area except legally established parking areas. - No parking on any driveway or in any free parking area between sunset and dawn of any day. Leave any vehicle anywhere in the park more than 24 hours without Township approval. At the end of this period, the vehicle will be towed away at the owner’s expense. Owner and or operator must be on premises with vehicle. Vehicle is subject to towing if left unattended on Township property. Fail to yield right-of way to a pedestrian crossing the driveway within any cross walk. Where traffic movement is being regulated by police officer or authorized traffic signals. Fail to stop behind such a vehicle that has stopped to permit a pedestrian to cross-driveway. Fail to yield right of way if moving across driveway, which is not marked-for crosswalk. No riding upon fenders and/or any other outside part of any vehicle parked or moving. Change any parts or make repairs of any vehicle on Township property, except such emergency repairs necessary to remove such vehicle from the property. Change oil or grease. Change oil, or grease, wash or polish vehicles and leave debris from such action. SECTION 19.O - REGULATION OF THE USE OF “OTHER MORTORIZED VEHICLES” It shall be unlawful for any person to operate a snowmobile, mini-bike, dirt bike, two or four wheel drive carts or off-the-road-type of vehicle on Township property. SECTION 2O.0 - REGULATION OF THE USE OF BICYCLES Individuals must operate bicycles in accordance with current state regulations in the Illinois Bicycle Rules of the Road Booklet. Ride any bicycle on any area except the paved park roads, parking areas or such other areas as specified. Leave a bicycle in a place other than bicycle rack when such is provided and there is space available. SECTION 21 .0 - RECREATIONAL ACTIVITIES Picnic, participate in or to take part of activities, abet the playing of any games involving thrown or otherwise propelled objects such as balls, model-airplanes, remote control air planes, boats, or helicopters etc. except in areas or facilities set apart for such forms of recreation and under such rules and regulations as designated. Hunt, trap or pursue wild life at any time. It is forbidden to shoot into park areas from beyond the park boundaries. Misuse of Play-lot equipment is grounds for immediate ejection. Skateboards, Skates, In-Line Skates and Roller blades shall not be allowed in any parking lots and roadways, use on sidewalks, basketball courts, ramps, railings, benches.
The Board of Trustees and Their Designee shall in connection with their duties imposed by law, diligently enforce the provisions of this Ordinance. The Board of Trustees its designees, police, any law enforcement office or authorized security personnel shall have the authority to eject from the park any person acting in violation of this Ordinance. The Board of Trustees, its designees, police, any law enforcement officer or authorized security personnel shall have the authority to require a showing of proof of identification (i.e. voters registration card, selective service registration, driver’s license, etc.) of any person using the park. The Board of Trustees its designees, police, any law enforcement officer or authorized security personnel shall have the authority to seize and confiscate any property, thing, or device in or used in the parks in violation of this Ordinance.
Interfere with unreasonably disrupt, delay or in any manner hinder any
Township employee or distract him/her from the performance of their duties. Fail to obey a lawful order of dispersal by Township personnel, police officer or security personnel under circumstances where person are committing acts of disorderly conduct or acts that are likely to cause substantial harm or serious inconvenience, annoyance or alarm. SECTION 24.0 - BANNED Any person found violating the provisions of this ordinance may be immediately expelled. Upon recommendation of the Township Board, the Township and/or the Supervisor may ban an individual from Township property for a period not to exceed thirty (30) days. Upon a majority vote of the Township Board, a person found violating this ordinance maybe denied access to Township property for a period in excess of thirty (30) days. A notice banning an individual from Township property shall be sent to the person at their last known address via certified mail with a return signature.
Any person found entering upon Fremont Township property after receiving notice banning that individual from Township property shall be subject to arrest and prosecution for criminal trespass to land unless such person has-a valid appointment with a Township official or employee for Services. SECTION 26.0 - PENALTY Any person violating the provision of this ordinance is subject to a minimum of $100 fined to a maximum of $750 per violation. In addition, any party damaging Township property shall be required to pay restitution to the Township for damages caused; additionally, court cost and lawyers fees incurred will be subject to reimbursement. SECTION 27.0 - EFFECTIVE DATE This ordinance shall be in full force and effect from after its passage and published in pamphlet form in a manner provided by law. SECTION 28.0 - SEVERABILITY In the event that any section, clause, provision, or part of this ordinance shall be found and determined invalid by a court of competent jurisdiction, all valid parts that are severable from the invalid parts shall remain in full force.
